These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "Customer") and Tholmarechik ("we," "us," or "our") regarding your access to and use of the website https://tholmarechik.world (the "Site") and any orders you place for products offered on the Site, including HerbaCardio. By accessing the Site, placing an order, or using our services, you agree to be bound by these Terms. If you do not agree, do not use the Site or place an order.

HerbaCardio and other products offered on the Site are dietary supplements or similar consumer products. They are not drugs and are not intended to diagnose, treat, cure, or prevent any disease. Use only as directed and in accordance with the product labeling. Consult your healthcare provider before use if you are pregnant, nursing, taking medication, or have a medical condition.

5. Orders and Acceptance

When you submit an order (e.g., by completing the order form and clicking the order button), you are making an offer to purchase the product(s) on the terms stated at the time of submission. We are not obligated to accept your order. Order acceptance may be communicated by order confirmation (e.g., by email or on-screen message) or by shipping the product. We may refuse or cancel orders for any reason, including but not limited to: product availability, errors in pricing or product information, suspected fraud, or failure to meet eligibility requirements. If we cancel an order after payment has been taken, we will refund you in accordance with our refund policy.

You are responsible for providing accurate and complete order and contact information. We are not liable for delivery failures or delays caused by incorrect address or contact details.

6. Pricing and Payment

All prices displayed on the Site are in United States dollars (USD) unless otherwise stated and are subject to change without notice. Prices do not include applicable sales tax, VAT, or other taxes or duties unless stated. You are responsible for any such taxes where applicable. You are responsible for filing any claims with the carrier for lost or damaged shipments.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THOLMARECHIK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, ORDERS, OR PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR YOUR ORDERS EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.

You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of such courts.

If you are a consumer in a jurisdiction that mandates different rules (e.g., mandatory consumer protection or venue), nothing in these Terms shall deprive you of those rights.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' intent.

These Terms, together with our Privacy Policy, Cookie Policy, and Return Policy (each as referenced and incorporated by reference), constitute the entire agreement between you and Tholmarechik regarding the Site and orders.
